Terms and Conditions

These terms and conditions (hereinafter, the “Terms”) regulate the business relationship and contract between “VARDALACHOS NIKOLAOS, 800 Boards Surf Club, Watersports equipment E-commerce and Rentals, Salaminomachon Coast 61, Salamina, 18900, GREECE, VAT number  EL104567650, Tax Authority: Ε' Peireaus, (tel: +30 6973201398, skype: nickvardalachos), registered with the General Commercial Registry (056590409000/3-4-11) and with the Commercial Registry of Piraeus (103360) (hereinafter, the “Provider” or “Administrator” or “we”) and the customer (hereinafter, the “Customer” or “User” or “you” or “your”) formalized through the use of the web site “www.800surfshop.com” (hereinafter, the “Website”) by the Customer for the purchase of products and services. The Terms also regulate the access to and use of the Website by the User. The Provider is the administrator of the Website and also the Data Controller for the purposes of the applicable data protection regulation.
The use of the Website and the sale of products and services via the Website are subject to the Terms, unless otherwise agreed in writing between the Provider and the Customer.

I. Acceptance
By using the Website you accept totally and without reservation the Terms as published on the Website at the time of use and/or placing an order, as applicable.
By clicking the “Place an order to buy this product” button, you make a legally binding commitment to purchase the product. The sales contract shall only enter into effect upon receipt by you of the Provider’s “Confirmation of Acceptance” (see the detailed “Contracting Procedure” section, herein below).
The Provider may change and update the Terms at any time, without warning you beforehand. However, once you have received confirmation from the Provider of receipt of your order, the Provider will not change the Terms applicable to that order.
It is advisable that you print out or save an electronic copy of the Terms when placing the order. 

II. Contracting Procedure
In order to place an order through the Web site, you must be 18 years or older and be an end consumer.
How to Place an Order
In order to place an order through the Website you must follow the following steps:
1. Find on the Website the desired product.
2. Click on “Place an order to buy this product ” and declare your commitment to buy the product. 
3. The Provider will confirm by email receipt of your order. It is clarified that at this stage the Provider is not yet obligated to execute your order. 
4. The Provider with check availability of the product. If the product is not available or will be available at later stage, the Provider will inform you accordingly via email. If the product is available, the Provider will send an email to you confirming availability, price of the product and shipping cost.
5. Once the Provider has confirmed to you availability, price of the product and shipping cost, you must reply by email to the Provider and indicate your payment option and your shipping address.
6. You make the payment.
7. If the payment is authorized and confirmed by the Provider, you will receive email confirmation by the Provider that your order has been accepted (“Confirmation of Acceptance”). This confirmation constitutes acceptance by the Provider of your order and creates a binding contract between Customer and Provider.
8. The Provider will proceed with shipping of the product.  
 
Submitting an order through the Website is subject to the availability of the products. The product display on the Website does not constitute a legally binding offer by the Provider; instead it is merely a non-binding online catalogue of the range of products available.
The prices shown on the Website are subject to variation. The Provider reserves the right to change prices without warning. However, once you have received confirmation from the Provider of receipt of your order, the Provider will not change payable price in respect of that order.
If the product ordered is not readily available or there is no stock of it, the Provider will inform you by e-mail, as described in the “Contracting Procedure” section, herein above.
Please note that, although the Provider takes reasonable care to confirm availability and specifications of the products and accuracy of the prices, specifications and prices shown may be in error. Any specifications and prices shown in error shall be amended as soon as possible and shall not be binding on the Provider.
The Provider reserves the right to reject any order. The Provider also reserve the right to cancel or not accept an order, even after confirming receipt of it, among other reasons, if there was a technical or pricing error on the Website at the time the order was placed.

III. Payment
The prices and offers presented on the Website include the Value-Added Tax (“VAT”) and are valid only for orders placed with the procedure described above, in section “Contracting Procedure”.

You can pay using one of the following ways:

Using your credit or debit card or your bank account via Paypal, the most popular and safest way for international transactions.

3. Cash on Delivery (for Greece only)
Your order can be paid by cash upon receipt from the Courier company. The maximum value of cash on delivery should not exceed 1.000 €, as required by the Courier company. There is a surcharge of 2.50 € for every delivery (all windsurfing or SUP boards are excluded from this option).

IV. Shipping and handling
All orders are sent by Courier or Shipping company from Monday to Friday and from 9:00a.m. to 16:00 p.m. except holidays.
Once all products are available, they are prepared and ready for shipment within 24 hours from the moment we confirm your payment order. Orders are not released for shipping until payment is confirmed. Shipments of Windsurfing Boards and SUP Boards may take a little more. For information please contact us.
We are not responsible for any delay or failure of delivery or failure in any performance due to, without limitation, factors such as strikes, extreme weather, governmental restriction, labor disturbances, unavailability of anticipated usual means of supplies, transportation or loading facilities, acts of God (force majeure) or any other causes beyond its reasonable control, BUT in such case we will take reasonable action to notify you via email.

The shipping costs are as follows:
For Greece:
1. For orders worth over 50 € FREE shipping.
2. For orders worth over 100€ from the Offers, FREE shipping.
3. For orders of less than 50 €, the shipping cost is:
Attica: 1 working day and costs 4.50€
Land Destinations: 1 to 2 working days and costs 6,60€
Island destinations: 1 to 3 working days and costs 8,00€
If the delivery address is in an inaccessible area, as defined by the Courier company, the parcel will be received from the nearest branch of this company in your area.
For E.U. countries listed below:
Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom.
1. For orders over 150€ FREE shipping (including products from Offers);
2. For orders less than 150€ the shipping costs 12€ (including products from Offers).
All windsurf and SUP boards are excluded from free shipping.
For non E.U. countries:
We can still have special shipping cost deals. Please contact us for more info.

V. Return & Exchange Policy
Case Α. You have the right to return a purchased product without giving any reason for doing so within 14 calendar days from the date you take possession on the product. (Right of Withdrawal)

In order to exercise your statutory right of withdrawal, you must notify the Provider by email at info[at]800surfshop[dot]com.
All returned products must be in excellent condition and not used, the packaging must not be altered and must contain all original content. In this case we cover return costs.
The statutory right of withdrawal shall not apply also in the following cases: (a) Delivery of products which have been manufactured on the basis of a personal choice or according to customer specifications, or of products which have clearly been tailored to the customer’s personal requirements; (b) Delivery of sealed products which are not suitable to be returned for reasons relating to health protection or hygiene if their seal has been removed after delivery.
Case B. You have the right to return purchased products and ask for a refund in cases where the product was defective or non-conforming, in accordance with Articles 534 et seq of the civil code, as applicable.
In order for return costs to be covered by us (case A), the products should always be returned by the same Courier company, which delivered your order, to the address below:
If return costs are charged to the consumer (case B), he is obliged to deliver the goods personally to the address below:

In all the above cases, the consumer is responsible for the deterioration or destruction or loss of products on their return. The refund to the consumer will be completed within 14 calendar days from the date we receive the products.
Before returning a product, it is indispensable to contact us.
The above provisions of this section are without prejudice to the Customer’s rights as a consumer under mandatory consumer protection law.

VI. Liability
The Terms set out the full extent of the Provider´s obligations and liabilities in respect of the supply of the products. There are no warranties, conditions or other terms that are binding on the Provider except as expressly stated in the Terms.
Subject to the above paragraph and to the maximum extent permitted by applicable law, the maximum aggregate liability of the Provider to the Customer on all claims of any kind under or related to these Terms and to the products and services offered, whether in contract, warranty, tort, strict liability, or otherwise, shall be limited to the amount paid to the Provider for the purchase of the product.
Nothing in these Terms shall limit or exclude the Provider’s liability imposed by applicable consumer protection law and which cannot be excluded by law.

VII. Protection of Personal Data
The personal data you provide to the Provider will be collected and processed by the Provider, under the capacity of a Data Controller, for the purposes of the business relationship and execution of the agreement between the Provider and the Customer, in accordance with applicable data privacy legislation. 
We respect your privacy. In cases when required by law, your prior consent will be obtained before we send to you advertising and commercial communication, including the sending (e.g. by e-mail, SMS) of commercial communications regarding products, services, offers, promotions, and news of the Provider, the Provider’s partners or trusted third parties.
The Provider will have in place and maintain technical and organisational security measures which are appropriate and sufficient to ensure the safety of your personal data.
If you have other questions or concerns, or in order to exercise your statutory rights of access and object to the processing of your personal data, please contact the Provider at info[at]800surfshop[dot]com.

VIII. Intellectual property rights
Unless otherwise indicated, the contents of the Website are the exclusive property of the Provider and or his content suppliers. The compilation of all content included in or made available through the Website is the exclusive property of the Provider. You may not extract and/or re-utilise parts of the content of the Website without the Provider’s express written consent. All trademarks not owned by the Provider that appear on the Website are the property of their respective owners.
Any copying, distribution, reproduction, process, sale, deception of the public regarding the real provider of this website, is strictly prohibited. Intellectual property rights

IX. Hyperlinks
The Website includes hyperlinks to websites and content owned and administered by third parties (including websites and content of the Provider’s business partners). The Provider is not responsible for examining or evaluating the said websites and contents and does not assume any responsibility or liability for the products, information and content of the said third party websites and contents and for the actions of the said third parties.

X. Applicable Legislation, Competent Jurisdiction and other provisions
Purchases made via the Website under these Terms are subject to Greek law, with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
Any dispute or discrepancy arising from the application or interpretation of these Terms, as well as the contracts incorporating them, will be submitted to the courts of Piraeus, Greece, which will have exclusive competency over any other venue.
If any of these provisions cannot be applied for whatever reason, this shall not affect the validity of the remaining provisions of the Terms.VII. Protection of Personal Data
